1. Scope of application
All orders shall only be accepted and executed in accordance with the following General Terms and Conditions of business. The customer acknowledges these by placing an order. Each order will only be executed once an offer has been accepted and an order placed in writing.
2. Completion of the translation order
All translations are carried out professionally. The client shall receive the translation as agreed verbally or in writing. Unless specific regulations or glossaries are provided, specialised terms are translated into a generally understandable form. The translation is always delivered without layout work. We will be happy to provide you with a quote on request.
3. Offers
The preparation of the offer is non-binding and free of charge. The validity period of the offers is 4 days.
4. Client’s obligation to co-operate
The client must inform The Post-Editors by delicatext GmbH in good time of any special requirements pertaining to the execution of the translation. Incorrect translations due to illegibility of the source text shall not be at the expense of The Post-Editors by delicatext GmbH. The client undertakes to check every translation delivered by The Post-Editors by delicatext GmbH for defects before forwarding the translation or using it elsewhere.
5. Remedy of defects / Liability / Claims for damages
We provide professional translations. Should one of our translations nevertheless have a defect, the client must notify us in writing within 2 weeks, otherwise the translation shall be deemed to be free of defects. In the event of a defect, the client is entitled to a corrected translation. Liability for consequential damages is excluded.
If the translation proves to be unsuitable for the purpose intended by the client (printing, advertising etc.), we reserve the right to rework it. The client shall be liable if they do not indicate that a translation is intended for printing, do not send us a revision proof before printing and/or have it printed without our approval. Under no circumstances shall this give rise to claims for damages against The Post-Editors by delicatext GmbH.
6. Delivery dates / Fixed dates / Delays / Shipping
Indicated delivery dates are estimates. They do not constitute a binding commitment.
Fixed dates shall only be deemed effective if we have expressly confirmed them in writing.
The Post-Editors by delicatext GmbH cannot be held liable for delays caused by malfunctions of e-mail programs and servers or other forms of transmission over which The Post-Editors by delicatext GmbH has no direct control.
The Post-Editors by delicatext GmbH is not liable for delays in processing your order if your e-mail lands in the SPAM folder or is deleted for various reasons. In such cases, we expressly draw our clients’ attention to their duty to co-operate. Please make sure that your order has been processed properly by telephone or e-mail if, for example, you have not heard back from The Post-Editors by delicatext GmbH within one business day of your enquiry/message or after the delivery deadline has passed.
Your documents and translations will be sent to you by e-mail.
7. Confidentiality / Data protection
The Post-Editors by delicatext GmbH undertakes to maintain secrecy about all facts that come to its knowledge in connection with its work for the client. All enquiries or orders placed will be treated confidentially in accordance with data protection regulations. The client agrees that their data will be stored for the processing and invoicing of their orders in accordance with the applicable EU General Data Protection Regulation.
We would like to point out that data transmission over the Internet (e.g. when communicating by e-mail) may be subject to security vulnerabilities. Complete protection of data against access by third parties is not possible.
8. Cancellation / Contract termination
The contract may only be terminated by the client for good cause. The termination must be declared to The Post-Editors by delicatext GmbH in writing. If the translation order has already been completed by the time of termination, The Post-Editors by delicatext GmbH shall be entitled to compensation covering the costs of the services rendered thus far.
9. Disruption, force majeure, server errors and viruses
No liability is accepted for damage caused by viruses, transmission faults or force majeure.
10. Prices
All prices are subject to change. The prices quoted are net prices.
11. Retention of title
The translation shall remain our property until full payment has been received.
12. Retention of translations and data
Once the order has been completed, the data transmitted by the client shall be deleted unless otherwise agreed. The provider shall not back up the data transmitted by the client.
13. Applicable law and place of jurisdiction
The contractual agreement between The Post-Editors by delicatext GmbH and the client is exclusively subject to Swiss law. The exclusive place of jurisdiction for all disputes for both parties is the registered office of The Post-Editors by delicatext GmbH.
14. Severability clause
Should one or more provisions of these GTC be or become ineffective for any legal reason, this shall not affect the remainder of the agreement.
